With praise of the Master of praise, the Bestower of virtues,
With praise to the Master of praise, bestower of virtues,
I compose an outstanding poem on these questions:
I compose sublime poetry on issues,
مسائلquestions عنconcerning شيخthe shaykh of الوجودthe world أوليpeople endowed with التقىpiety
مبيدvanquisher of العدىthe enemies منamong كلevery غاوٍerrant person وجاهلand ignorant person
Questions concerning the shaykh of the world, O people of piety,
Issues about the Sheikh of existence, the most pious,
The vanquisher of enemies, every errant and ignorant man.
Eradicator of enemies, of every misguided and ignorant one.
وأعنيand I mean بهby him الحبرthe learned scholar بنson of يتيمةYatīmah (apparently Taymiyyah) الرضىthe esteemed
وفيand in بعضهاsome of them جاءتarose عضالgrievous الزلازلupheavals
I mean the esteemed scholar, Ibn Yatīmah [apparently Ibn Taymiyyah],
I mean Al-Habr ibn Yatimah Al-Ridha,
Over some of these questions, grievous upheavals arose.
In some of which complex earthquakes occurred,
تفردhe differed عنfrom نعمانNuʿmān فيهاin them ومالكand Mālik
وعنand from أحمدAḥmad والشافعيand al-Shāfiʿī الأماثلthe eminent men
In them he differed from Nuʿmān and Mālik,
He differed from Nu'man in them and Malik,
And from Aḥmad and al-Shāfiʿī, those eminent men.
And from Ahmad and Al-Shafi'i the exemplars.
وقدand indeed جاءcame بعضsome الصحبcompanions يسألrequesting نظمهاtheir versification
فأحببso I wished (as intended) أنto أحظىwin بدعوةa prayer from سائلa supplicant
Some companions came requesting their versification,
Some companions came asking for their poetry to be composed
So I wished to win a supplicant's prayer,
So I loved to gain the prayer of the asker,
وإنalthough لمnot أكنI am ذاpossessed of خبرةexperience ودرايةand understanding
ولستand I am not لتحقيقfor investigating العلومthe sciences بآهلqualified
Though I possess neither experience nor understanding,
Although I have no expertise or knowledge,
And am not qualified to investigate the sciences.
And am not qualified for verifying sciences.
ولكننيbut I أرجوhope for منfrom اللهGod رحمةmercy
وعلماًand knowledge وتفهيماًand understanding granted بكلof all المسائلthe questions
Yet I hope for mercy from God,
But I hope for God's mercy,
And knowledge and understanding of all these questions.
And knowledge and understanding of all issues.
فأولهاso the first of them قصرshortening الصلاةprayer لكلfor everything ماthat
بهin it سفرa journey لدىaccording to كلevery قائلspeaker
The first is shortening prayer for anything that
The first is shortening the prayer for any
Is considered a journey in ordinary speech.
Travel, according to every speaker.
وسيانand equally alike عندin the view of الشيخthe shaykh كانتwas طويلةlong
مسافتهits distance أوor دونهless than it فيin التماثلequivalence
To the shaykh it is the same whether long
And they are equal according to the Sheikh, whether
Its distance is, or shorter: both are alike.
Its distance was long or similar in likeness.
وذاand this مذهبa legal view للظاهريةof the Ẓāhirīs قدindeed أتىhas been transmitted
وعنand from بعضsome أصحابCompanions of النبيthe Prophet الأفاضلthe eminent
This view has been transmitted from the Ẓāhirīs,
This is the doctrine of the Dhahiris that came
And from some of the Prophet's eminent Companions.
And from some of the Prophet's excellent companions.
وتستبرئand must establish her womb is clear البكرthe virgin الكبيرةthe adult عندهمin their view
وكانand he was إلىtoward أقوالهمtheir opinions غيرnot مائلinclined
They require an adult virgin to establish that her womb is clear,
And they consider the unmarried mature woman excused with them
But he was not inclined toward their opinions.
And he was not inclined to their sayings.
ويختارand he chooses ماwhat اختارhe chose البخاريal-Bukhārī وقدand indeed أتىthere came
بذاon this أثرa transmitted report عنfrom نجلthe son of حلوsweet in الشمائلcharacter
He chooses what al-Bukhārī chose, and there has come
And he chooses what Al-Bukhari chose, and he came
A report on this from the son of a man gracious in character.
With this on the authority of the son of sweet traits.
وذاكand that man هوis الفاروقal-Fārūq والقولand the opinion لابنهis his son's
وثالثهاand the third of them ماwhat قالهhe said it فيon المسائلthe questions
That man is al-Fārūq, and the opinion is his son's.
And that is Al-Farouq, and the saying is of his son,
The third is what he stated among these questions:
And thirdly what he said in issues.
فيختارso he chooses ماwhat اختارواthey chose لسجدةfor the prostration of قارئa reciter
بغيرwithout شاتراطstipulation (as intended) للوضوءof ablution لفاعلfor its performer
He adopts their view on a reciter's prostration,
I meant the son of the Caliph of piety
Without requiring ablution of the one performing it.
So their doctrine is no make-up for the doer.
ومعتقداًand one believing ليلاًit to be night فبانthen it became clear بضدهto be its opposite
لأكلconcerning eating ومطعومand food بشهرin the month of الفضائلvirtues
And one who believed it was night, but it proved otherwise,
And their principle is what is mentioned in the two Sahihs
When eating and taking food in the month of virtues—
Which has passed versified so do not be neglectful
فليسthen is not القضاmaking up the fast يوماًa day عليهupon him بواجبobligatory
وماand not حكمهhis ruling إلاَّexcept كناسٍlike a forgetful person's وجاهلand an unaware person's
Making up a day is not obligatory for him;
And whoever was enjoying their Hajj,
His ruling is only that of someone forgetful or unaware.
Obligatory or else in all supererogatories.
وماand did not أمرcommand المعصومthe infallible one منwhoever كانwas مخطئاًmistaken
منamong الصحبthe Companions أنto يقصضيmake up (as intended) الصيامthe fast فسائلso ask
The infallible one did not command those who erred
One Sa'i suffices him in his choice,
Among the Companions to make up their fast—so ask.
And Ahmad reports it from some of the virtuous.
كذلكlikewise بعضsome التابعينthe Successors وبعضand some منof those
إلىto الفقهjurisprudence منسوبattributed ومنand those known للفضائلfor virtues
Likewise some of the Successors, and some
And Ibn Abbas was a proponent of that
Known for jurisprudence and for virtues.
So he is a greater role model of virtues.
عنيتI meant بهby him نجلthe son of الخليفةthe caliph ذيpossessed of التقىpiety
فمذهبهمso their view ألاis that there is no قضاءmaking up لفاعلfor the person acting
I mean the pious caliph's son:
And the Sheikh permitted racing without
Their view is that the person need not make it up.
Making it permissible what is not a day for fasting.
وعمدتهمand their authority ماwhat فيin الصحيحينthe two Ṣaḥīḥ collections ذكرهits mention
وقدand already مرhas appeared منظوماًin verse فكنso be غيرnot غافلheedless
Their authority is its mention in the two Ṣaḥīḥ collections,
Even if they stipulate an award and this is his choice,
Already given in verse; so do not be heedless.
And he was an imam, scholar of issues.
ومنand whoever كانis فيin حجاتهhis pilgrimages متمتعاًperforming tamattuʿ
بفرضas an obligation وإلاor otherwise فيamong جميعall النوافلvoluntary acts
Whoever performs his pilgrimages in the tamattuʿ form,
And one who is redeemed, she is excused with her menses,
Whether obligatory or among the voluntary pilgrimages,
In this is a mursal hadith among transmitters.
فيكفيهthen it suffices him سعيsaʿy (ritual walking) واحدone فيaccording to اختيارهhis chosen view
وعنand from أحمدAḥmad يرويهtransmits it بعضsome الأفاضلeminent scholars
In his chosen view, a single saʿy suffices.
And coitus, o friend, I mean with suspicion,
Some eminent scholars also transmit this from Aḥmad.
And one who is divorced one of the three perfections.
وكانand was ابنIbn (son of) عباسʿAbbās بذلكof that قائلاًan advocate
فأعظمhow great بهhe is منas قدوةan exemplar ذيpossessed of فضائلvirtues
Ibn ʿAbbās held this opinion:
Likewise, one who copulates with a woman made lawful
What a great exemplar he is, possessed of virtues!
By ownership, of the beautiful idolaters.
وقدand indeed جوزpermitted الشيخthe shaykh السباقracing بغيرwithout أنthat
يحللهmakes it lawful ماone who (as intended) ليسis not يوماًever بجاعلputting up a stake
The shaykh permitted racing without
And he permitted contracting for a cloak for a pilgrim
A participant who stakes nothing making it lawful,
With his pilgrim garb so understand the speech of the virtuous.
وإنeven if أخرجاthe two put up جعلاًa prize وهذاand this اختيارهhis chosen view
وكانand he was إماماًan imam عالماًknowledgeable بالمسائلabout the questions
Even if both put up a prize; this was his choice.
And he permitted a menstruating woman to perform tawaf
He was an imam knowledgeable about these questions.
And not what they have made obligatory with the like.
ومنand she who تفتديransoms herself تستبرئنmust establish her womb is clear بحيضهthrough one menstrual period
وفيand concerning ذاthis حديثa hadith مرسلwith its Companion narrator omitted فيamong المراسلsuch reports
A woman who ransoms herself must await one menstrual period,
If she could not perform tawaf while pure
And on this there is a mursal hadith among such reports.
And her companions had approached departure.
وموطؤةand a woman with whom intercourse occurred ياO صاحfriend أعنيI mean بشبهةunder a mistaken claim of right
ومنand she who طلقتwas divorced إحدىwith one of الثلاثthe three الكواملcomplete pronouncements
Likewise a woman with whom intercourse occurred, my friend, under a mistaken claim of right,
And he permitted selling juice with its origin
And a woman divorced by one of the three complete pronouncements.
Like oil with olives so do not be unaware.
كذاlikewise وطئintercourse with منone who حزيتwas acquired (as intended) بملكthrough ownership إباحةlawful permissibility
منamong الوثنياتthe pagan women الحسانthe beautiful الخواذلthose who hold aloof
Likewise intercourse with one acquired through lawful ownership,
Likewise ablution, o friend, from everything that may
Among the beautiful pagan women who hold aloof.
Be called pain, is permissible without obstruction.
وجوزand he permitted عقدtying a knot للرداءin the mantle لمحرمfor one in iḥrām
بإحرامهduring his iḥrām فافهمso understand مقالthe statement of الأفاضلthe eminent
He permitted tying the mantle for one in iḥrām,
Equal to him absolutely or restricted,
During his consecration; understand the words of the eminent.
And we saw from him unrestrictedly in issues.
وجووزand he permitted (as intended) ياO صاحfriend الطوافcircumambulation لحائضfor a menstruating woman
وليسand he is not لماwith what قدalready أوجبوهthey made it obligatory بماثلin accord
He permitted, my friend, circumambulation for a menstruating woman,
And he permitted selling jewelry and other things
Not according with what they had made obligatory,
If made of silver with the difference.
إذاif كانit was لمnot يمكنpossible طوافcircumambulation in طهارةritual purity
ورففقتهاand her companions (as intended) قدalready قربواhad drawn near للرواحلto the mounts
If circumambulation in ritual purity was not possible,
For it and the surplus is made for the one
And her companions had drawn near to their mounts.
Who made it with the superior in exchange.
وجوزand he permitted بيعاًa sale للعصيرof juice بأصلهin exchange for its source
كزيتlike oil بزيتونfor olives فكنso be غيرnot غافلheedless
He permitted selling juice in exchange for its source,
And if it falls into a liquid of filth,
As oil for olives; so do not be heedless.
Whether little or not carrying.
كذاكlikewise الوضوablution ياO صاحfriend منwith كلanything ماthat عسىmay
يسمىbe named بهby it ألماًwater (apparently intended) جائزpermitted غيرwithout حائلan impediment
Likewise, my friend, ablution with anything that may
It does not become impure with him
Be called water is permissible, without impediment.
And he was more deserving of proofs than them.
سواءٌequal لديهin his view مطلقاًunqualified أوor مقيداًqualified
وعنهand from him رأيناwe have seen مطلقاًwithout qualification فيin المسائلthe questions
To him, unqualified and qualified water are alike,
And whoever feared missing Eid or Friday
And we have seen this stated from him without qualification in these questions.
Loss and water is not available that day.
وجوزand he permitted بيعاًa sale للحليof jewelry وغيرهاand things other than it
إذاif اتخذتthey are fashioned فيin فضةsilver بالتفاضلwith unequal amounts
He permitted the sale of jewelry and other objects,
If he performs Tayammum that is
When made of silver, for unequal amounts
Permissible to him so meet virtue with reward.
بهاof it والذيand what قدhas زادbeen added يجعلis assigned للذيto that which
لصنعتهاfor its workmanship فيas فاضلa surplus فيin المقابلthe countervalue
Of silver; whatever exceeds the amount is assigned
And from what transpired from them are disasters,
To its workmanship, as a surplus in the countervalue.
Great sins, and the like came to it with earthquakes.
وإنand if وقعتfalls فيinto مائعa liquid منsome نجاسةimpurity
سواءwhether قليلاًlittle أوor يكنit is غيرnot حاملbearing it (sense unclear)
If some impurity falls into a liquid,
By his fatwa that divorce when it comes
Whether little in quantity or not bearing it [wording unclear],
Thrice in one statement without completion.
ولمand does not يتغيرchange ليسnot ينجسbecomes impure عندهin his view
وقدand indeed كانhe was أحظىmore richly endowed منهموthan they بالدلائلwith proofs
And it does not change, he does not deem it impure.
And none takes place, but rather all those together
He was more richly furnished with proofs than they.
Are one according to his saying like examples,

فواتاًmissing it وليسand is not الماءwater يوماًever بحاصلobtainable
Whoever fears missing the Eid prayer or the Friday prayer,
From the companions in the era of the Prophet and after him
When no water can be obtained,
Until it was permitted with a just punishment.
فإنthen if تيممhe performs dry ablution كانis ذلكthat عندهin his view
يجوزpermitted فقابلso meet بالثناwith praise كلevery فاضلworthy person
If he performs dry ablution, in his view
And if separated, when it would not have been
That is permitted; so meet every worthy person with praise.
Upon the way of the infallible, best of the virtuous.
ومماand among what جرىbefell منهاfrom them عليهhim فوادحgrievous calamities
عظامimmense وجاءتand they came نحوهtoward him بالزلازلwith upheavals
From some of these there befell him grievous calamities,
And from one who swore off divorce in his oath
Immense ones, which assailed him with upheavals,
An expiation, but it is with tremors.
بإفتائهthrough his ruling أنthat الطلاقdivorce إذاif أتىis pronounced
ثلاثاًthree times بلفظin an utterance واحدsingle غيرnot كاملcomplete
Through his ruling that if divorce is pronounced
And he was threatened, rather harmed, for his fatwa with it
Three times in a single utterance, it is not complete,
And how many times until now from the aggressive.
ولاand not واقعtaking effect بلrather إنindeed تلكthose جمعيهاall of them

Nor does it take effect as such; rather, all of those
And the Sheikh Imam wrote a book,
Count as one in his view, as with the eminent
With a thousand pages, repelling the questioner.

Companions in the Prophet's time and afterward,
But he will meet with his opponent
Until it was enforced as a punishment by one who was just.
Before God and the Merciful, most just of judges.
ولوeven if فرقتthey were separated إذاif هيthey لمnot تكنwere

علىaccording to سنةthe practice of المعصومthe infallible one أفضلthe noblest فاضلof the noble
Even if pronounced separately, when they were not
And in some of what I have composed in verse,
In keeping with the practice of the infallible one, the noblest of the noble.
There are positions from them regarding issues.
ومنand whoever بطلاقby divorce حالفswears فيمينهthen his oath
مكفرةexpiable لكنbut هيit بالقلاقلis fraught with turmoil
Whoever swears an oath by divorce—his oath
And he said this is what he differed with them in
Is expiable, though this is fraught with turmoil.
The Sheikh, this is an outline for the transmitter.
وعوديand he was opposed بلrather أوذيhe was harmed لإفتائهfor his ruling بهاon it
وكمand how many مرةtimes إلىup to ذاthis الآنpresent time منby متحاملa hostile critic
He was opposed—indeed harmed—for issuing this ruling,
May God join all the youth have granted
And how often, even up to now, at a hostile critic's hands!
And what the blowing winds have quenched for the bereaved.
وقدand indeed كتبwrote الشيخthe shaykh الإمامthe imam مصنفاًa work

The shaykh, the imam, wrote a work
Upon Muhammad the guiding, trusted, Prophet
Of thousands of pages to repel an assailant.
And his companions and family, people of virtues.

Yet he and his adversary will meet
Before God; the All-Merciful is the most just of the just.

In some of what has passed, of what I have versified,
There are positions among theirs that accord with his on these questions.

He said: 'This is what was uniquely held, apart from them,
By the shaykh'; this reproduces a transmitter's handwritten text.
