جازَ التِماسٌ إِعادَةَ الأَنظارِ في

حُكمِ الحُقوقِ الاِنتِهائي ثاني

Reviewing judgment is legally allowed

As a final judgment authority again

وَيَكونُ في نَفسِ المَحاكِمِ ما بَدا

وَجهٌ لَهُ مِن سِتَّةِ لَمَعانِ

And this can happen in the same courts that

Issued various perspectives, six facets shining

أَولاهُم طَلَبٌ تَقَدَّمَ لَم يَحُز

حُكماً وَأَهمَلَ حَيِّزَ النِسيانِ

First, a request was filed but no ruling yet

So it slipped into oblivion's crevice

وَبِعَكسِهِ حُكمٌ بِشَيءٍ لَم يَكُن

مِن طَلبَةِ الأَخصامِ في حُسبانِ

Or a judgment on something not requested

By the opponents, not in their thoughts or planning

وَإِذا أَتى أَحَدُ الخُصومِ بِخِدعَةٍ

غَشَّت قُضاةُ الحُكمِ بِالبُهتانِ

Or if one opponent tricks with cunning

Deceiving the judges with lies and conning

وَثُبوتُ تَزويرٍ لا وَراقَ بِها

كانَ القَضاءُ مُؤَسِّسُّ البُنيانِ

Or finding forged papers, not endorsed

Though the ruling seemed a sturdy construction

وَظُهورَ أَوراقٍ تُفيدُ حَقيقَةً

قَد كانَ أَخفاها الخَصيمِ الثاني

Or papers come forth showing the true case

One opponent had earlier hid from sight

وَتَناقَضَ في الحُكمِ يَأتي واضِحاً

فَيَعودُ تَنفيذٌ بِلا إِمكانِ

Or contradictions in the judgment are clear

So enforcement is rendered impossible, right?

لَكِنَّهُم شَرَطوا لِذَلِكَ وَعِدَّةً

شَهراً تَماماً تالي الإِعلانِ

But they required for that a certain period

Exactly one month after declaration

وَالشَهرُ في حُكمِ الغِيابِ فَحَيثُما

سَقَطَت مُعارَضَةٌ يَفوتُ زَمانِ

And one month in absentee rulings, wherever

Objections are dropped, time will pass in evasion

وَالغِشُّ وَالتَزويرُ وَالوَرَقُ ال

خَفي كَما مَضى تَوضيحُهُ بِبَيانِ

And deceit, forgery, hidden papers, as

Explained before, need no further illustration

فَمَعادُهُم في الشَهرِ لا يَبدا بِهِ

قَبلَ الظُهورِ بِحَجَّةٍ وَعَيانِ

So review in a month does not proceed

Without evidence first and clear demonstration

فَإِذا اِنقَضى ذا الشَهرِ دونَ تَطَلُّبِ

نُفِّذَ القَضاءُ وَلاتَ حينَ أَماني

And if that month goes by with no demanding

The ruling's enforced, hopes turn to lamentation

وَالحُكمُ في المَعروضِ يُصدِرُ أَوَّلاً

بِقُبولِهِ أَو رَفضِهِ بِهَوانِ

In the case filed, it first rules accept

Or reject, with grace or humiliation

وَالرَفضُ يَستَدعي أَخي غَرامَةٍ

فَاِحذَر وَلا تُقدِم عَلى الطُغيانِ

Rejection risks a fine, so take care, brother

Not to proceed with injustice and transgression

وَإِذا تَقَبَّلَ فَالمَحاكِمُ عِندَها

تَستَفحِصُ المَوضوعَ فَحَصا ثاني

If accepted, the court then scrutinizes

The case again with utmost precision

وَتَنُصُّ حُكماً لا سَبيلَ لِنَقضِهِ

أَمّا بِفَوزٍ كانَ أَو حِرمانِ

Issuing a ruling that cannot be vetoed

Whether it brings loss or retribution

أَمّا الجِنايَةُ في نِهايَةِ حُكمِها

فَالنَقَضُ وَالإِبرامُ غَوثُ العاني

As for felony at judgment's end

Veto and finality give the weary elation

وَغَرامَةً يَقضي بِها في جُنحَةٍ

ظَهَرَت مُخالِفَةً لَدى الإِمعانِ

And for misdemeanor it rules compensation

If examination found contravention

وَالحُكمُ بِالتَضمينِ بَعدَ بَراءَةٍ

بِمَبالِغَ في حَيِّزِ النُقصانِ

And liability after acquittal

With reduced sums, not just a donation

وَهيَ الَّتي ما جوزَ اِستَئنافَها

كَالأَلفِ غَرشَ وَقُل يا إِخواني

Sums that cannot be appealed, like a

Thousand piasters, brothers, is legislation

وَشُروطُ هَذا النَقضِ هُنَّ ثَلاثَةٌ

تَبدو لِاَهلِ النَقدِ وَالعِرفانِ

Conditions for appeal are only three

Visible to critics seeking erudition

إِذا كانَ أَمراً ثابِتاً في حُكمِهِم

ما عاقَبَ القانونُ فيهِ الجاني

If the ruling upholds what the law

Does not penalize for that violation

وَإِذا بَدا خَطَأٌ بِتَطبيقِ النُصو

صِ عَلى الوَقائِعِ واضِحُ التِبيانِ

Or an evident mistake in applying

Texts to facts, clearly a deviation

أَو قَد رَوى في الحُكمِ وَجهٌ مُبطِلٌ

وَكَذا بِإِجراآتِ أَهلِ الشانِ

Or the reasoning of the ruling is flawed

Including in the procedures of litigation

وَمَفادُ الإِجراآتِ مُنصَرِفٌ إِلى

ما كانَ مِن شَكلٍ وَمِن أَركانِ

The procedures refer to matters of form

And principles, composition and creation

فَإِذا أَتَيتَ بِأَيِّ شَرطٍ مِنهُم

حُزتَ القُبولَ وَفُزتَ بِالإِذعانِ

If you fulfill any condition thereof

You'll gain acceptance and yield veneration

وَالنَقضُ يَحصُلُ بِالكِتابَةِ عاجِلاً

في أَودَةِ الكِتابِ دونَ تَوانِ

Appeal occurs by writing promptly

In the petition's case, no procrastination

إِذ أَنَّ أَيّامَ المَعادِ ثَلاثَةٌ

لا تُستَزادُ وَلا بِبَعضِ ثَواني

As the days for review are only three

Not increased, not even by brief hesitation

فَاِسرِع وَهُم وَلا تَضيعَ فُرصَةٌ

وَكُلُّ أُمورِ لِرَبِّكَ الحَنّانِ

So hurry and avoid missing the chance

Entrust all affairs to your Lord of compassion
